Terms and Conditions for BUSINESS CUSTOMERS


1. PURPOSE – PRESENTATION OF THE SELLER

The company 2CV MÉHARI CLUB CASSIS, a simplified joint-stock company (SAS) with a share capital of €87,810.63, having its registered office at CS 80019, 13714 Cassis Cedex, France, registered with the Marseille Trade and Companies Register under number 38508116100031, VAT number FR 73 385 081 161, email address: pieces-detachees@mehariclub.com, telephone number: +33 (0)4 42 01 07 68 (hereinafter referred to as “2CV MÉHARI CLUB CASSIS” or “we”), offers for sale car spare parts (mainly for Citroën 2CV, 2CV vans, Méhari, Dyane, Acadiane, and Ami models) (hereinafter referred to as the “Products” or “Product”) on the website https://www.mehariclub.com/en/ (hereinafter the “Website”) to any natural or legal person acting as a trader or in the course of their professional activity (hereinafter the “Customer” or “you”).


2. SCOPE AND ENFORCEABILITY

These General Terms and Conditions of Sale (hereinafter, the “GTC”) govern, without restriction or reservation, all sales concluded by 2CV MÉHARI CLUB CASSIS with Customers wishing to purchase Products offered for sale on the Website.

These GTC prevail over any other document, including any general purchasing conditions.

They may be supplemented by specific conditions stated on the Website before any transaction with the Customer.

The GTC have been made available to you prior to the conclusion of the sale and are accessible at any time on the Website. You acknowledge having read and accepted them, without reservation and in their entirety, by ticking the box “I acknowledge that I have read and accept the General Terms and Conditions of Sale.”

The GTC in force at the date of the order shall prevail over any previous or contradictory version.

2CV MÉHARI CLUB CASSIS reserves the right to amend these GTC at any time and without notice, it being specified that the applicable GTC will be those in effect on the date of the Customer’s order.

If any provision of the GTC is found to be invalid or unenforceable, the other provisions shall remain unaffected.

The Customer guarantees that they have the required legal capacity to enter into a contract and purchase the Products offered on the Website.


3. PRODUCTS

The Products offered for sale are presented on the Website with a description of their essential characteristics, a photograph, a reference number, and a price.

We reserve the right to modify our catalog of Products available on the Website at any time.

The Customer is required to review this information before placing any order, it being specified that the selection and purchase of a Product are the Customer’s sole responsibility.

The photographs of the Products displayed on the Website are not contractual, and we shall not be held liable for any minor differences between the presentation photos and the delivered Products.

The Website indicates whether the Products are available in stock. Despite regular stock updates, discrepancies may occur between the stock level displayed on the Website at the time of ordering and the actual stock at the time the order is recorded. You will be informed in the event of the sudden unavailability of one or more Products after your order has been placed. You may then choose either to receive your order at a later date or to request a refund if payment has already been processed. An email will inform you of the estimated availability dates of the affected Products.


4. ORDERS

4.1 Mandatory prior registration

Before placing an order, you must create an account on the Website by providing your details on the registration form (country, company name, intra-community VAT number except for Customers located outside the European Union, first name, last name, address, postal code, phone number, email, and password). After completing this registration process, we will send you an email confirming the creation of your account and containing your login details (email address and chosen password).

You guarantee that the information provided is accurate, complete, and up to date. You are solely authorized to use these credentials and agree to take all necessary measures to keep them personal and confidential.

You agree to notify us of any unauthorized use of your account or password, or any breach of account security, by email at contact@mehariclub.com. You may close your account at any time by sending an email to contact@mehariclub.com.

4.2 Placing an order

To place an order, you must log in to your account on the Website using your credentials. You must then select the Products you wish to order, following these steps :

  • Choose the desired quantity of the selected Product ;
  • Click the “Add to cart” button ;
  • Choose to either continue shopping or proceed to checkout;
  • After selecting your Product(s), a summary of your cart will be displayed with the total cost of your order ;
  • Click on “Validate my cart” ;
  • Choose a delivery method (click & collect at 2CV Méhari Club Cassis, home delivery, or pickup point delivery) ;
  • Confirm or enter your delivery address, then click “Validate my delivery” ;
  • Tick the box “I acknowledge that I have read and accept the General Terms and Conditions of Sale” ;
  • Choose a payment method (credit card, check, or bank transfer) ;
  • Enter the required information depending on the chosen payment method (for card payments: card number, expiry date, and security code) ;
  • Confirm the payment.

Up until the payment step, you may review or modify your order by clicking on your cart located at the top right of the Website. It is your responsibility to verify the accuracy of your order and correct any errors. You may also cancel your order before payment.

4.3 Order confirmation

An order confirmation will be displayed on the Website after your order has been recorded. It will also be sent to your registered email address.

Once confirmed and accepted by us, the order cannot be modified or cancelled, except in cases of force majeure.

The order confirmation includes a summary of the order contents, the order number, payment method used, detailed total amount, billing and delivery addresses, and a link to access your invoice in your personal account on the Website.

Order details, as well as your order history and invoices, remain accessible in your personal account on the Website.

4.4 Order archiving

Each order is archived by 2CV MÉHARI CLUB CASSIS for a period of ten (10) years. You may access the details of your past orders at any time by logging into your account or by sending an email to pieces-detachees@mehariclub.com.

4.5 Evidence agreement

Unless proven otherwise, computer and digital records stored in the Website’s IT infrastructure shall constitute proof of all transactions concluded with the Customer.


5. PRICES

Products are supplied at the prices in effect on the Website at the time your order is recorded by 2CV MÉHARI CLUB CASSIS.

Prices displayed on our Website are, by default, expressed as All Taxes Included (ATI), including French VAT at the applicable rate of 20% or 10%, and in euros. Once the business customer has logged in using their credentials, prices will then be displayed exclusive of taxes (ET) and in euros.

Prices take into account any discounts that may be granted by 2CV MÉHARI CLUB CASSIS on the Website. Professional customers may therefore benefit from personalized pricing incorporating a discount ranging from 5% to 30% compared to the public price.

The amount of this specific discount granted to each professional customer depends on the nature of the products ordered and is determined according to several criteria:

  • The total amount of the customer’s orders over a reference period
  • The growth in order volume between the last two reference periods
  • The average order value placed (excluding shipping costs) during the reference period
  • The proportion of the total order amount placed on the 2CV MÉHARI CLUB CASSIS website during the reference period, compared to the total amount of all orders placed through all sales channels (website, telephone, trade shows, etc.)

The calculation scale for this personalized discount is set out in Appendix 1.

The amount of the personalized professional discount is updated annually, based on the application of the calculation scale set out in the appendix to a 12-month reference period running from March 1 of each year to the last day of February of the following year. The annual update of the personalized professional commercial discount will be applied no later than March 15 of each year, i.e. 15 days after the end of the reference period.

When creating their account, the professional customer will benefit from a minimum discount of 5%, which will be reassessed in accordance with the criteria defined in the calculation scale at the end of the current reference period.

2CV Méhari Club Cassis also reserves the right to:

  • Grant, on a case-by-case basis, a higher discount than that resulting from the application of the calculation scale
  • Modify the calculation scale applicable to its professional customers at any time
  • Modify, at its discretion, the duration of the reference period as well as its end date for selected customers

Prices do not include shipping costs, which are charged in addition under the conditions indicated on the Website and calculated before placing the order. These costs are detailed in Article 7 below.

We reserve the right to modify our prices at any time, it being understood that the applicable and invoiced prices are those in effect on the Website on the date of order confirmation.

Before validating the order, you will be informed of the delivery charges and the total price to be paid.

Prices shown on the Website do not include customs duties that may be charged to you for deliveries outside the European Union. These duties are detailed in Article 8 below.


6. PROMOTIONAL CODES

Promotional codes applicable to all or certain purchases of Products and specific services (including delivery fees) made on the Website may be offered at any time by 2CV MÉHARI CLUB CASSIS as part of promotional campaigns.

Promotional codes are valid for a limited period (the duration of which is specified on the Website). They are non-transferable and cannot be exchanged or purchased from 2CV MÉHARI CLUB CASSIS. Unless otherwise stated, only the Customer who has received the promotional code is entitled to use it. A minimum and/or maximum purchase amount may be specified for each promotional code.

Our promotional codes may grant a percentage discount on certain products, on all or part of an order, or entitle the Customer to receive free products.

In the event of a full or partial return of Products covered by a promotional code, the amount of the promotional code applied to the order related to the returned Product will be deducted from the amount refunded to the Customer by 2CV MÉHARI CLUB CASSIS.


7. DELIVERY FEES

For the delivery of Products — excluding in-store pickup via the “Click & Collect” service of 2CV MÉHARI CLUB CASSIS — orders are subject to delivery fees, which are indicated separately from the Product prices prior to order confirmation and form an integral part of the order. Delivery fees may be waived during promotional periods or under certain conditions.

Free delivery for orders from €125 excl. VAT: 

All business customers are eligible for free delivery on all orders shipped to mainland France (including Corsica) with a total value excluding VAT of €125 or more, excluding delivery charges, and excluding bulky parcels. Free delivery does not include the delivery of oversized parts, for which flat-rate delivery surcharges will apply to the same destinations: €30 (incl. VAT) for 2CV platforms; €50 (incl. VAT) for Méhari body tubs and bodyshell kits; €630 (incl. VAT) for 2CV body shells. Trailers are shipped on a quoted basis.

Official distributors or members of the 2CV MÉHARI CLUB CASSIS Point-Relais Network will benefit from free delivery on orders over €125 (excl. VAT), with no weight limit on parcels and no flat-rate delivery surcharges for oversized parts. The 2CV Méhari Club Cassis also reserves the right to offer specific delivery rates to its best business customers.

The free delivery method offered may vary depending on the nature of the order and the delivery location.

In all other cases (orders under €125 excluding VAT and deliveries outside mainland France), delivery charges will apply. These charges will be calculated based on the volume and weight of the parcel for the order in question and its delivery location.


8. CUSTOMS DUTIES

When ordering Products for delivery outside the European Union, customs duties, local taxes, import duties, or state taxes may be payable upon receipt of the package. These additional costs are not the responsibility of 2CV MÉHARI CLUB CASSIS. They are at your expense and under your sole responsibility, including their declaration and payment to the competent authorities and/or agencies of the destination country. These fees vary by country, and we recommend that you inquire with the local authorities for more information. In such cases, you are considered the importer of the Products in the destination country.

We reserve the right not to deliver Products destined for a territory or country subject to economic sanctions (including, but not limited to, comprehensive and/or sectoral embargoes and sanctioned parties). You agree not to provide, sell, transfer, export, retransfer, re-export, make available, or use any Product supplied by 2CV MÉHARI CLUB CASSIS for the benefit of any party and/or country subject to economic sanctions.


9. PAYMENT

The price is payable in full at the time of placing the order by the Customer.

An order becomes effective only upon receipt of payment, which may be made by credit card (Visa, Eurocard, Mastercard), bank cheque (from a French account only), postal cheque payable to 2CV MÉHARI CLUB CASSIS, bank transfer, or money order. For orders placed from abroad, depending on the country, only payments by credit card (Visa, Eurocard, Mastercard), bank transfer, or PayPal are accepted.

If payment is incomplete or missing for any reason attributable to you, the order will be automatically canceled, and any resulting costs will be borne by you, without prejudice to potential damages and interest.

Upon receipt of full payment for the order, an email will be sent to inform you of the shipment of your package and the availability of your invoice, which can be viewed and downloaded via the link in the email directing you to your personal space on the Website. In the case of in-store pickup, the invoice will be handed to you at the time of collection.


10. PRODUCT COLLECTION AND DELIVERY

You may choose between in-store collection at 2CV MÉHARI CLUB CASSIS and home delivery to an address of your choice.

10.1 Collection in Cassis

By choosing the “Pickup at Méhari Club Cassis” option, you agree to collect your order directly at one of the “Click & Collect” pickup points of 2CV MÉHARI CLUB CASSIS, located either at Quartier le Bregadan, Cassis (13260), or 1 Chemin du Mont Gibaou, Cassis (13260), depending on the weight and size of the package. Collections are available during business hours, Monday to Friday, from 9 a.m. to 12 p.m. and from 2 p.m. to 5 p.m.

Pickup is available once you have received an email indicating that your order is ready.

Products will remain available for pickup at the “Click & Collect” points for two (2) weeks from the receipt of the confirmation email.

If you do not collect your order within this period, the Products will be returned to stock and will no longer be reserved for you. You will then need to contact 2CV MÉHARI CLUB CASSIS again to arrange a new pickup appointment.

10.2 Delivery terms and timeframes

The ordered Products are delivered to the delivery address indicated when you placed your order. The delivery address may differ from the billing address.

If the delivery address is located outside the European Union, additional taxes and customs fees may apply (see Article 8).

Except in cases of force majeure or carrier network disruptions, the Products ordered will be delivered within seven (7) business days from the date of shipment to the address provided by the Customer during the order process on the Website.

We undertake to use our best efforts to deliver the ordered Product(s) within the above-mentioned timeframes and to inform you of any potential delays. The delivery periods indicated are for reference only and not guaranteed.

The Customer can track the progress of their order on the Website. For any questions regarding order tracking, you may contact the after-sales service by phone at +33 (0)4 42 01 07 68 (press 4) or by email at sav@mehariclub.com.

If the Products have not been delivered within thirty (30) days from the delivery date indicated at the time of ordering on the Website, for any reason other than force majeure or the Customer’s fault, the sale may be canceled upon the Customer’s written request.

Delivery delays shall not give rise to any penalty, compensation, or withholding.


11. TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

Ownership of the Products shall only be transferred to you after full payment of the order price, including all taxes and fees, regardless of the delivery date of said Products.

Irrespective of the date of transfer of ownership, the transfer of risks of loss or damage to the Products shall occur only when you, or any third party designated by you, take physical possession of the Products.


12. TRANSPORT

It is the Customer’s responsibility, in the event of damage to or missing Products upon delivery, to make all necessary reservations with the carrier.

Any Product not subject to specific written reservations by registered letter with acknowledgment of receipt or by official notification within three (3) days of receipt from the carrier, in accordance with Article L.133-3 of the French Commercial Code—and a copy of which must be simultaneously sent to 2CV MÉHARI CLUB CASSIS—shall be deemed accepted by the Customer.

Our liability cannot, under any circumstances, be incurred for claims related to transport (destruction, damage, loss, theft, etc.), even if we have chosen the carrier.


13. RECEIPT

Without prejudice to the measures that the Customer must take with the carrier as described above, and regardless of the delivery method, any claims regarding the non-conformity of the delivered Product(s) with the order or the delivery note must be reported to 2CV MÉHARI CLUB CASSIS within forty-eight (48) hours following receipt of the Product(s) (pickup or delivery note signature):

  1. Either by registered letter with acknowledgment of receipt to:
    2CV MÉHARI CLUB CASSIS, CS 80019, 13714 Cassis Cedex, France,
  2. Or by email to: sav@mehariclub.com.

If the non-conformity of the Product(s) is confirmed, we will issue a return authorization, specifying the address and return procedures. The Products must be returned in the condition in which they were received, with all components (accessories, packaging, manuals, etc.). Return costs will be covered by us either through a prepaid return label or reimbursement of the actual return costs.

In the event of a confirmed non-conformity by 2CV MÉHARI CLUB CASSIS, the Customer may choose between free replacement or reimbursement of the Product(s), to the exclusion of any further compensation or damages.

If no claim is made under the conditions described above, the Products shall be deemed accepted and conforming in quantity and quality to the order.

Claims made by the Customer under this article shall not suspend payment for the Product(s) concerned.


14. WARRANTY AGAINST HIDDEN DEFECTS

2CV MÉHARI CLUB CASSIS guarantees its Products against hidden defects in accordance with Articles 1641 et seq. of the French Civil Code.

As the Customer is a professional, a hidden defect is understood to be a manufacturing defect making the Product unsuitable for its intended use and not detectable by the Customer prior to use.

Under the legal warranty against hidden defects resulting from a defect in material, design, or manufacture:

  • You have two (2) years from discovery of the defect to take legal action;
  • You may choose between rescission of the sale or a price reduction, as provided in Article 1644 of the French Civil Code.

To exercise your rights, you must notify us in writing of the discovery of the defect within the above timeframe and return or bring the defective Products, with all their components (accessories, packaging, manuals, etc.).

An inspection will be carried out by our teams to verify the claimed defect.

We will refund, replace, or repair only the defective Product(s) covered by the warranty. No other compensation will be granted, particularly for indirect damages or business losses.

If a refund is chosen, it will be made within thirty (30) days after confirmation of the hidden defect, by bank transfer or cheque.

The legal warranty against hidden defects applies independently of any commercial warranty that may be granted.


15. COMMERCIAL WARRANTY – STANDARD EXCHANGE ENGINES

From the purchase date shown on the invoice of the standard exchange engine, warranty coverage for manufacturing defects applies without mileage limitation, under the following conditions:

15.1. 6-Month Warranty if :

  • The original oil breather has been replaced (purchase must appear on the same invoice as the engine).
  • Installation instructions (see page 8 of the supplied booklet) have been strictly followed.
  • Labor costs for engine removal and refitting are not covered, unless installation was performed in our workshops or if the Serenity Engine Warranty option was purchased.

15.2. 24-Month Warranty if :

  • Purchase of the commissioning kit (the purchase of the commissioning kit must appear on the same invoice as the standard exchange engine and on the same date).
  • Replacement of the original oil breather.
  • Replacement of the recycling hoses.
  • Replacement of the air filter cartridge.
  • Replacement of the oil pressure switch (manocontact).
  • Strict compliance with the installation instructions (see page 8 of the booklet supplied with the engine).
  • The warranty does not cover labor for removing and refitting the engine unless the installation was carried out in our workshops or you have subscribed to the Serenity Engine Warranty option.

These warranties cannot be extended.

In the event of an issue, contact our After-Sales Service immediately at +33 (0)4 42 01 07 68 or sav@mehariclub.com for instructions—either to return the engine for inspection or to authorize a professional repair under our responsibility.

The warranty covers only the replacement or repair (at our discretion) of parts manufactured by us found defective. We shall not bear any costs related to vehicle downtime, consequential damage, or accidents of any kind.

If replacement is deemed necessary, shipping costs will be covered by us, and the warranty will be renewed.

Labor costs will only be covered if the installation was done in our workshops and the Serenity option subscribed. Fluids and routine maintenance are excluded.

15.3. Warranty Conditions :

  • The initial installation of the engine and all adjustments must be carried out by a 2CV MÉHARI CLUB CASSIS distributor, an authorized 2CV MÉHARI CLUB CASSIS relay point, or a qualified automotive professional.
  • The installation instructions provided must be strictly followed.
  • The removal and refitting of the engine under warranty must be performed by the same professional, subject to prior approval by 2CV MÉHARI CLUB CASSIS of their repair estimate. The costs of towing and travel remain the Customer’s responsibility.

15.4. Warranty Exclusions :

L’exclusion de la garantie interviendra dans l’un des cas suivants :

  • Use of synthetic oils ;
  • Unauthorized repairs ;
  • Engine seizure due to oil shortage or oil cooler failure ;
  • 1,000 km inspection not performed by a qualified professional ;
  • Vehicle sold to a new owner ;
  • Break-in period not observed ;
  • Faulty installation or adjustment, including flywheel tightening issues ;
  • Engine dismantled or returned without prior authorization ;
  • Use outside manufacturer specifications (e.g., competition or industrial use) ;
  • Failure to replace the oil breather ;
  • Damage caused by malfunctioning peripheral components.

15.5. Optional “Serenity Warranty” Insurance :

Under the Serenity Warranty insurance, 2CV MÉHARI CLUB CASSIS covers all costs related to :

  • Return and re-shipment of the engine after repair ;
  • Removal and reinstallation of the engine ;
  • Replacement of necessary parts.

The commercial engine warranty does not replace the legal warranty for hidden defects (Articles 1641–1649 and 2232 of the French Civil Code).


16. COMMERCIAL WARRANTY – ORIGINAL AND ADAPTABLE CHASSIS PLATFORMS

16.1. Original Platforms Warranty

  1. a. Original cataphoretic platforms (Refs. 10071000, 10071013, 10071015, 10071017, and 10071005 [platform only, untreated]) :
  • Platform : 2-year warranty
  • Anti-corrosion treatment : 10-year warranty

Exclusions :

  • Improper use of the vehicle (platform or treatment)
  • Sale of the vehicle resulting in change of ownership
  1. b. Original galvanized platforms (Ref. 10071010) :
  • Platform : 2-year warranty
  • Anti-corrosion treatment : lifetime warranty

Exclusions :

  • Improper use of the vehicle (platform or treatment)
  • Sale of the vehicle resulting in change of ownership

16.2. Adaptable Platforms Warranty

Cataphoretic or galvanized adaptable platforms are covered under the following warranty conditions :

  • Platform : 2-year warranty
  • Anti-corrosion treatment : 2-year warranty

The commercial warranty for Original and Adaptable Platforms does not replace the legal warranty against hidden defects as provided under Articles 1641 to 1649 and 2232 of the French Civil Code.


17. WARRANTY LIMITATIONS

Our liability shall not be incurred in the following cases:

  • Non-compliance with the legislation of the country where the Products are delivered;
  • Use not conforming to manufacturer specifications;
  • Professional or commercial use of the vehicle;
  • Negligence;
  • Defects resulting from Customer error, mishandling, accident, abnormal use, improper installation, maintenance, or storage;
  • Normal wear and tear.


18. WEBSITE ACCESS

We are only bound by a best-effort obligation regarding the operation and continuity of the Website. Consequently, we shall not be held liable for damages resulting from use of the Website or the Internet network, such as data loss, intrusions, viruses, slow connections, downtime, inaccessibility, fraudulent use by third parties, technical failures, or incompatibility with your software, systems, or devices.


19. INTELLECTUAL PROPERTY

The Website and all its components (texts, photographs, images, data, etc.) are protected by intellectual property rights and remain the exclusive property of 2CV MÉHARI CLUB CASSIS.

The name, domain name, logos, images, and other distinctive signs identifying 2CV MÉHARI CLUB CASSIS are also protected by intellectual property law. Any reproduction, adaptation, or use of these distinctive signs is strictly prohibited and constitutes an infringement.


20. FORCE MAJEURE

2CV MÉHARI CLUB CASSIS shall not be held liable to the Customer if the non-performance or delay in the performance of any of its obligations under these General Terms and Conditions of Sale (GTCS) results from a case of force majeure.

A case of force majeure refers to any event beyond the control of the obligated party, which could not reasonably have been foreseen at the time of the contract’s conclusion, the effects of which cannot be avoided by appropriate measures, and which prevents the performance of the obligation, in accordance with Article 1218 of the French Civil Code.

Force majeure shall be deemed to include, without the non-performing Party having to prove that the event meets the above criteria, the following: war, terrorist attack, armed conflict, embargo, nationwide strikes, natural disasters, earthquake, typhoon, flood, fire, explosion, hurricane, power outage, network failure, computer disruption, requisition at 2CV MÉHARI CLUB CASSIS, its suppliers or subcontractors, epidemic, pandemic, and/or any governmental decision impacting the performance of the Contract.

In such cases, 2CV MÉHARI CLUB CASSIS reserves the right to suspend or terminate the sale of Products, in whole or in part. The Company shall not be held liable for any non-performance and shall not owe any damages or penalties for delay.

If the event of force majeure is temporary and does not exceed ninety (90) days, the performance of obligations shall be suspended for the duration of the event.

If the event is permanent or lasts more than ninety (90) days, the sale governed by these GTCS shall be automatically terminated after notification from 2CV MÉHARI CLUB CASSIS to the Customer referring to this clause.


21. HARDSHIP

In the event of unforeseeable changes in circumstances at the time of the sale’s conclusion, and in accordance with Article 1195 of the French Civil Code, 2CV MÉHARI CLUB CASSIS, which has not agreed to assume the risk of excessively burdensome performance, may request a renegotiation of the sale with the Customer.

However, if the unforeseeable change of circumstances proves to be permanent or persists beyond ninety (90) days, the sale shall be automatically terminated upon receipt by the Customer of a notification from 2CV MÉHARI CLUB CASSIS referring to this clause of the GTCS.


22. PERSONAL DATA – GDPR

You are invited to refer to the personal data policy of 2CV MÉHARI CLUB CASSIS, which applies to all personal data collected in connection with registration, ordering, and business relationships.


23. APPLICABLE LAW – LANGUAGE

These GTCS are governed by French law.

They are written in French. In the event that they are translated into one or more other languages, only the French version shall prevail in case of dispute.


24. CLAIMS – MEDIATION

In the event of a claim, you may contact the After-Sales Service:

You have a period of six (6) months from the disputed event to file a claim.

You may also resort to conventional mediation with a view to amicably resolving the dispute.

The appointed mediator is the Centre de Médiation et d’Arbitrage de Paris (CMAP).

You must send a complete file, including all documents exchanged with the After-Sales Service, in accordance with the procedures available on the CMAP website: https://www.cmap.fr/?lang=en.

In the absence of an amicable agreement, any dispute, of any nature whatsoever, relating to these General Terms and Conditions of Sale (GTCS) or to the sales and purchase transactions concluded between 2CV MÉHARI CLUB CASSIS and the Customer shall fall under the exclusive jurisdiction of the French courts, including in cases involving multiple defendants, third-party proceedings, or summary proceedings.

 




APPENDIX 1

CALCULATION SCALE FOR THE PERSONALIZED DISCOUNT APPLICABLE TO EACH PROFESSIONAL CUSTOMER


Appendix 1.1 :

Each professional customer benefits from two personalized discount rates:

  • A personalised trade discount rate applicable to standard products.
  • A personalised trade discount rate applicable to specific products, which applies to platforms, 2CV body shells, tyres, tow bars, 602 parts developed by our partner Burton, and products from the Beta, Motul, Restom and Wynn’s ranges.


Appendix 1.2 Discount scale for standard products:

The discount applied to each professional customer corresponds to the sum of the discounts determined according to each of the following four criteria:

  • A. Total order amount during the reference period
  • B. Growth in the total order amount between the last two reference periods
  • C. Average order value during the reference period (excluding delivery costs)
  • D. Proportion of the total order amount placed on the 2CV MÉHARI CLUB CASSIS website during the reference period

A. Discount based on the total amount of effective orders placed by the customer during the reference period (excluding cancellations or returns):

  • If the customer’s personalised professional discount rate on standard products is 15% or higher, their personalised professional discount rate on specific products is 10%
